Terms of Use

1. Introduction

These Terms of Use ("Terms") govern your use of the OBDify Car Diagnostic mobile application ("App"), provided by OBDify Sp. z o.o. ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree with these Terms, do not use the App.

2. Purpose and Functionality

The App enables users to:

• Connect to compatible OBD adapters.
• Perform vehicle diagnostics.
• View sensor data.
• Read and clear diagnostic trouble codes.
• In certain cases, modify vehicle settings.

Additional information:

• We process personal data on several legal bases — including your consent, contractual necessity and our legitimate interests — and some operational data (e.g. anonymous error logs and telemetry) is collected by default. See our Privacy Policy for details and your choices.
• Certain features may require specific hardware compatibility.

3. User Responsibility and Risk Acknowledgement

• You acknowledge that certain features of the App may allow modification of vehicle systems and settings.
• You agree that any such use is entirely at your own risk.
• You are solely responsible for ensuring that any actions performed via the App are legal, safe, and appropriate for your vehicle.
• You must not use the App while driving.

4. Disclaimer of Liability

To the maximum extent permitted by law:

• OBDify Sp. z o.o. is not liable for any damage, loss, injury, or malfunction arising from your use of the App, including but not limited to vehicle damage, safety hazards, voided warranties, or violations of applicable laws.
• The App is provided on an "as is" basis without warranties of any kind, express or implied.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, nor does it affect your mandatory statutory rights as a consumer.

5. Eligibility and Legal Compliance

• You must be old enough to enter into a binding agreement in your country (the age of majority), or use the App with the consent and involvement of a parent or legal guardian.
• You are responsible for ensuring compliance with local laws and regulations related to vehicle diagnostics and modification.

6. Account, Subscriptions, and Vehicle Access

• Certain features require creating an account.
• The App offers two independent ways to access paid functionality: (a) an optional subscription, which unlocks premium features for use with any compatible vehicle; and (b) a one-time, per-vehicle VIN access purchase, which unlocks the App's full functionality for that specific vehicle.
• These options are independent. A VIN access purchase does not require an active subscription to use the App with that vehicle; equally, a subscription does not require a VIN purchase. You may use either, or both.
• VIN access is a one-time payment, not a subscription. It remains valid for as long as we continue to provide the App and its supporting online services. It is not a perpetual or "lifetime" licence: access depends on the continued availability of the service and may end if the App or its supporting services are discontinued. Where reasonably possible, we will give advance notice before any planned discontinuation.

7. Account Deletion

You may delete your account at any time directly from the app settings. Alternatively, you can contact us at contact@obdify.net to request account deletion.

Upon account deletion, we will permanently delete your account and associated personal information, except where retention is required by law (e.g. transaction records for tax purposes).

8. In-App Purchases and Subscriptions

The App offers paid features, including one-time per-vehicle VIN activations and optional subscriptions. VIN activations are one-time purchases, not subscriptions, and are subject to the service-availability terms in Section 6.

• Purchases are processed securely via Google Play or Apple App Store.
• Your access to purchased features is tied to your account and cannot be transferred.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the billing period.
• You can manage or cancel subscriptions through your Google Play or Apple account settings.
• Refunds are handled in accordance with Google Play or Apple App Store policies.

Right of withdrawal (EU/EEA consumers). If you are a consumer in the EU/EEA, you normally have a 14-day right to withdraw from a distance purchase. Because our paid features are digital content/services that are made available immediately, you expressly request and consent to immediate performance at the time of purchase and acknowledge that you thereby lose your 14-day right of withdrawal once access has been provided. All purchases are made through the Apple App Store or Google Play, whose purchase, consent and refund procedures apply; statutory consumer rights that cannot be waived (for example, remedies for content that does not work as described) remain unaffected.

9. Intellectual Property

• The App, its design, code, and content are owned by OBDify Sp. z o.o. or its licensors.
• You may not copy, modify, reverse engineer, distribute, or resell the App without prior written consent.

10. Prohibited Uses

You must not:

• Use the App to engage in illegal activities.
• Interfere with or disrupt the App's operation.
• Attempt to bypass or circumvent the App's security, licensing, or access-control mechanisms.

11. Updates and Changes

We may update the App and these Terms from time to time. Continued use after changes constitutes acceptance of the new Terms.

12. Termination

We may suspend or terminate your access if you breach these Terms or use the App in a way that may harm others or us.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland. Any disputes shall be resolved by the courts in Gdańsk, Poland.

If you are a consumer, this choice of law and jurisdiction does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence, and you may also bring or defend proceedings in the courts of that country where applicable law so allows.
